Description of Our Business
These Terms of Use, together with Habitual Money, Inc. Privacy Policy, set forth the terms and conditions ("Terms") that apply to your access and use of all Habitual Money, Inc. ("Habitual", “we”, "our", "us") products and services. By accessing or using our services you consent to the Terms. The terms explain Habitual Money, Inc. practices on our website (www.habitual.money or any other site that redirects to an application of Habitual Money Inc.) and mobile application, collectively referred to as the Site.

Habitual Money, Inc. reserves the right to update the Terms from time to time at our sole discretion by posting such revised Terms to our Site. Please note the Effective Date of our terms set forth above. It is your responsibility to review this Privacy Policy regularly for any changes each time that you use the Site or mobile application.

Use of the Site by you following our posting of new Terms constitutes your acceptance of the Privacy Policy and Terms of Service, any changes will apply to all information received after the Effective Date of the modification. In the event we materially change the way in which we use your personal information that we have previously collected, we will provide you with a notice and respect your use of the Site and mobile application.

Description of our business
Habitual Money, Inc., the Site and mobile applications provide solutions that allow you to effectively manage your money. Habitual Money, Inc. does not encourage irresponsible use of credit lines and accepts no liability for effects on your credit score, incurred debt, or adverse effects of opening new accounts.
Delivering advertising
The Site, mobile application and our service providers may use information about your interactions with the Site to predict your interest and select ads that you may see on and off our Site. Habitual Money, Inc. does not consent to the sale of any of your personal data.
Disputes between you and Site
Any dispute must be resolved in binding arbitration or small-claims court and you waive the right to participate in any class action.
Intellectual Property and User Content
The contents of the Site and Services, including its “look and feel” (e.g., text, graphics, images, logos and button icons), photographs, editorial content, notices, software (including html-based computer programs) and other material are protected under both United States and other applicable copyright, trademark and other laws. The contents of the Services belong or are licensed to Habitual Money, Inc.

Habitual grants you the right to view and use the Services subject to these terms. Any distribution, republished, transmitted, uploaded, posted, reprint or electronic reproduction of any content from the Services in whole or in part for any purpose is expressly prohibited without our prior written consent. You agree not to use, nor permit any third party to use, the Site or the Services or content in a manner that violates any applicable law, regulation or this Agreement.
Indemnification
You agree that you will personally be responsible for your use of the Site, and you agree to defend, indemnify, and hold harmless Habitual Money, Inc. from and against any and all claims, liabilities, damages, losses, and expenses that may arise out of the use of the Site.
Force Majeure
‍Any computer system, service, or electronic device, whether it is yours, an internet service provider’s, a mobile network operator’s, or ours, can experience unanticipated outages, slowdowns, or capacity limitations. As a result of high internet traffic volume, transmission problems, systems capacity limitations, and any other problems, you may experience difficulty accessing the Service or communicating with us through the internet or other electronic and wireless services.

The Site or app may be unavailable during system maintenance, for security precautions, or when interrupted by circumstances beyond our control. Habitual will not be liable for any delay or failure to perform any obligation herein if the delay or failure is due to any of the foregoing or for any other unforeseen events that are beyond Habitual’s reasonable control, such as strikes, blockade, war, terrorism, riots, natural disasters, epidemic, pandemic, quarantine, faulty or failure of the internet or any public telecommunications network, or governmental action.
Access and Responsibilities

You are entirely responsible for maintaining the security and confidentiality of your login credentials. You agree to notify Habitual immediately of any unauthorized use of your account or any other breach of security. To notify us, contact us at support@habitual.money. You are responsible for all use of the Service occurring under your account and all content posted with your account on the Service. You are responsible for keeping your login credentials confidential and for notifying us if your login credentials have been hacked or stolen. Habitual will not be liable for any loss that you may incur as a result of someone else using your login credentials or account, either with or without your knowledge. You may be held liable for any losses incurred by Habitual or another party due to someone else using your account or login credentials.

HABITUAL, ITS AFFILIATES, AND ITS THIRD PARTY PROVIDERS, LICENSORS, DISTRIBUTORS OR SUPPLIERS (COLLECTIVELY, "SUPPLIERS ") MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE CONTENT OR OPERATION OF THE SITE OR OF THE SERVICES. YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. Online and Mobile Notifications
When you register with Habitual, Habitual may from time to time send you automatic and voluntary push notifications based on the notification preferences you have selected (“Notifications”). Some Notifications may be turned on by default. By using the Service, you agree to receive Notifications regarding your use of the Service and your Account Data. While Notifications are intended to enhance your use of the Service, you may disable Notifications on your device. Depending on which Notifications you elect to receive, Notifications may contain sensitive information.

You can opt-out of receiving further promotional emails or texts from us by following the unsubscribe instructions provided in the promotional email you receive, by updating your settings in the app, or by emailing us directly at support@habitual.money with “OPT-OUT”, “UNSUBSCRIBE”, “STOP”, or “REMOVE” in the subject line.

You understand and agree that any alerts provided to you by Habitual cannot control certain factors relating to message delivery. We may not be able to transmit a Notification to you in a timely and accurate manner. We have no liability for transmission delays or Notification failures, for any erroneous content in a Notification, or for any actions taken or not taken in reliance on a Notification.
Social Media Sites
Habitual may provide experiences on social media platforms such as Facebook, Twitter, TikTok and LinkedIn that enable online sharing and collaboration among users who have registered to use them. Any content you post, such as pictures, information, opinions, or any Personal Information that you make available to other participants on these social platforms, is subject to the Terms of Use and Privacy Policies of those platforms.

Please refer to those social media platforms to better understand your rights and obligations with regard to such content.
Termination & Enforcement
The term of these Terms will commence on the date on which you first access or utilize the Service in any way and will continue so long as you continue to access or utilize the Service, unless earlier terminated by Habitual. If you violate these Terms , your permission to use the Services will automatically terminate. In addition, Habitual Money, Inc. in its sole discretion may suspend or terminate your use of the Site and mobile application.

We reserve the right to:
- Restrict, deactivate, and/or terminate your access to the Service (or any portion thereof) for any or no reason, including without limitation, any violation of these Terms of Services at any time and without notice to you.
- Take appropriate legal action, including without limitation, referral to law enforcement, for any illegal or unauthorized use of the Site.

Without limiting the foregoing, we have the right to fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity or other information of anyone posting any materials on or through the Website.

YOU WAIVE AND HOLD HARMLESS THE COMPANY AND ITS AFFILIATES, LICENSEES AND SERVICE PROVIDERS FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY THE COMPANY/ANY OF THE FOREGOING PARTIES DURING OR AS A RESULT OF ITS INVESTIGATIONS AND FROM ANY ACTIONS TAKEN AS A CONSEQUENCE OF INVESTIGATIONS BY EITHER THE COMPANY/SUCH PARTIES OR LAW ENFORCEMENT AUTHORITIES.
Limitation of Liability
In no event will Habitual, its affiliates or their licensors, service providers, employees, agents, officers or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the website, any websites linked to it, any content on the website or such other websites or any services or items obtained through the website or such other websites, including any direct, indirect, special, incidental, consequential or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

In no event will the collective liability of Habitual and its subsidiaries and affiliates, and their licensors, service providers, employees, agents, officers and directors, to any party (regardless of the form of action, whether in contract, tort or otherwise) exceed the amount you have paid to the company for the applicable content, product, or service in the last twelve months out of which liability arose.

The foregoing does not affect any liability which cannot be excluded or limited under applicable law.
